| | 80% of federal court cases will result in dismissal or other dispositive motion prior to trial (ARCHIVE)CAO-City Attorney's Office |
Measure Definition & Importance |
Civil lawsuits filed against the City in federal court create financial risk because of the potential of high monetary damages being assessed against the City. Dismissal of lawsuits prior to trial conserves City resources. This measurement also assists the department in identifying whether city policies are defensible in a court of law. Pretrial dismissal can be resolved through pre-trial motions or settlement; this measure tracks the number of cases per quarter that are closed as a result of pre-trial motion or settlement versus trial.
The overall target is 80%.
